Bucky's Bootcamp - Terms and Conditions

Welcome to Bucky's Bootcamp. By participating in our fitness classes, and/or personal training sessions, and/or deep tissue massage, you agree to the following terms and conditions. Please read them carefully.

1. Definitions

"Bootcamp": Refers to the fitness training program(s) offered by Bucky's Bootcamp.
"Participant": Refers to any individual who enrolls in or attends a Bootcamp session.
"Instructor": Refers to the qualified fitness professional(s) leading the Bootcamp sessions.
"We", "Us", "Our": Refers to [Your Company Name/Bootcamp Name].
"You", "Your": Refers to the Participant.
2. Health and Medical Disclaimer

2.1. Physical Activity Risk: You acknowledge that participation in a fitness bootcamp involves strenuous physical activity and carries inherent risks, including but not limited to, muscle strains, sprains, falls, and in rare cases, more serious injuries. You voluntarily assume all risks associated with your participation.

2.2. Medical Clearance: You confirm that you are in good physical condition and have no medical conditions that would prevent you from participating safely in the Bootcamp. It is your sole responsibility to consult with a medical professional (e.g., your GP, doctor) before commencing any new exercise program, including this Bootcamp, especially if you have any pre-existing medical conditions, injuries, or concerns.

2.3. Declaration of Health: By signing up, you declare that you are medically fit to participate and that you will inform the Instructor immediately of any changes to your health, medical conditions, or any discomfort experienced during a session.

2.4. No Medical Advice: Our Instructors are not medical professionals and cannot provide medical advice or diagnosis. Any information provided by Instructors is for general fitness guidance only and should not be considered a substitute for professional medical advice.

3. Registration and Payment

3.1. Booking: All Bootcamp sessions must be booked in advance. Spaces are limited and allocated on a first-come, first-served basis.

3.2. Payment: Full payment is required at the time of booking to secure your place. Payment methods accepted are displayed on our website.

3.3. Pricing: Pricing for Bootcamp packages and individual sessions is as displayed on our website/booking platform and is subject to change at our discretion.

4. Cancellations and Refunds

4.1. Participant Cancellations:
* If you cancel your booking with 24 hours notice, you may be eligible for a credit for future session.
* Cancellations made with less than 24 hours notice will result in the forfeiture of the session fee.
* No-shows will not be refunded or credited.

4.2. Bootcamp Cancellations:
* We reserve the right to cancel or reschedule Bootcamp sessions due to unforeseen circumstances (e.g., severe weather, instructor illness, insufficient participants).
* In the event of a cancellation by us, you will be offered a full refund or the option to reschedule your session. We will endeavor to provide as much notice as possible.

5. Participation and Conduct

5.1. Punctuality: Participants are expected to arrive on time for sessions. Latecomers may be denied participation if their arrival disrupts the session or compromises their safety by missing warm-up instructions.

5.2. Follow Instructions: You must follow all instructions given by the Instructor during sessions. For your safety and the safety of others, failure to follow instructions may result in removal from the session without refund.

5.3. Appropriate Attire: You must wear appropriate athletic clothing and footwear suitable for exercise.

5.4. Respectful Conduct: All participants are expected to treat Instructors and other participants with respect. Abusive, disruptive, or inappropriate behavior will not be tolerated and may result in immediate removal from the Bootcamp without refund.

5.5. Personal Belongings: You are responsible for your personal belongings. We are not liable for any loss, theft, or damage to your personal property brought to the Bootcamp.

6. Limitation of Liability

6.1. Exclusion of Liability: To the fullest extent permitted by law, Bucky's Bootcamp, its instructors, employees, and agents shall not be liable for any personal injury, loss, or damage to property arising out of or in connection with your participation in the Bootcamp, except where such injury, loss, or damage is caused by our negligence.

6.2. Indirect Loss: We shall not be liable for any indirect or consequential loss or damage, including but not limited to loss of profits, revenue, or business opportunities.

7. Photography and Marketing

7.1. Consent: From time to time, we may take photographs or videos during Bootcamp sessions for promotional and marketing purposes (e.g., website, social media).

7.2. Opt-Out: If you do not wish to be photographed or videoed, please inform the Instructor at the start of the session. We will make reasonable efforts to accommodate your request.

8. Data Protection and Privacy

8.1. Collection of Data: We will collect and process your personal data (e.g., name, contact details, emergency contact) for the purpose of managing your booking, participation, and for communication related to the Bootcamp.

8.2. Privacy Policy: Your personal data will be handled in accordance with our Privacy Policy, which is available below. We comply with GDPR regulations.

9. Governing Law and Jurisdiction

9.1. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

9.2. Jurisdiction: Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Amendments to Terms and Conditions

10.1. We reserve the right to update or amend these Terms and Conditions at any time. Any changes will be posted on our website and will be effective immediately upon posting. Your continued participation in the Bootcamp after any such changes constitutes your acceptance of the new Terms and Conditions.
